Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Wizbee ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App. If you are a parent or guardian downloading the App for your child, you accept these terms on behalf of your child.

2. Description of Service

Wizbee is an educational game application designed for children ages 2-6. The App provides:

• Interactive learning games covering colors, shapes, numbers, animals, emotions, daily routines, and music
• AI-powered adaptive difficulty that adjusts to your child's age and skill level
• Parent Dashboard with progress tracking and parental controls
• Screen time management tools
• Offline gameplay capability

3. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on Apple devices that you own or control, subject to these Terms and the Apple App Store Terms of Service.

4. Subscriptions and In-App Purchases

The App offers the following subscription plans:

• Free Tier: One free mode per game, 3 daily game sessions
• Wizbee Plus (Monthly/Yearly): Unlimited games, all modes, detailed progress reports
• Wizbee Family (Monthly/Yearly): Plus features + up to 5 child profiles, AI-powered curriculum
• Lifetime Access: One-time purchase for permanent access to all features

Subscription terms:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel subscriptions in your Apple ID Account Settings (Settings > Apple ID > Subscriptions)
• No refunds will be provided for the unused portion of any subscription term
• Prices may vary by region and are subject to change

5. Parental Responsibility

Wizbee is designed for use by children under parental supervision. As a parent or guardian:

• You are responsible for supervising your child's use of the App
• You are responsible for setting appropriate screen time limits
• You are responsible for any purchases made through your Apple ID
• You acknowledge that the App stores your child's first name and age locally on your device

6. Prohibited Uses

You agree not to:

• Use the App for any illegal purposes
• Attempt to hack, reverse engineer, decompile, or interfere with the App
• Redistribute, sublicense, or commercially exploit the App
• Remove any copyright or proprietary notices from the App
• Use automated tools or bots to interact with the App

7. Privacy

Your use of the App is also governed by our Privacy Policy. We are committed to protecting the privacy of children and comply with COPPA and applicable children's data protection regulations.

8. Intellectual Property

All content in Wizbee, including but not limited to games, graphics, text, audio, animations, and the underlying algorithms, is protected by intellectual property laws and is owned by or licensed to us. You may not copy, modify, or distribute any part of the App without our written permission.

9. Disclaimers

The App is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that:

• The App will be error-free or uninterrupted
• The educational content will achieve specific learning outcomes
• The App will be compatible with all devices or operating system versions

10. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data or unauthorized access to your device.

11. Updates and Modifications

We may update the App or these Terms from time to time. We will notify you of significant changes through:

• Updating the "Last updated" date at the top of these Terms
• In-app notifications for significant changes

Continued use of the App after changes constitutes acceptance of the new terms.

12. Termination

You may stop using the App at any time by deleting it from your device. We reserve the right to terminate or suspend access to the App for violations of these Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes shall be resolved in the courts of Turkey. For users in the European Union, local consumer protection laws may also apply.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
